1. Introduction

By listing your vehicle for sale through the Joburgpretoriacars.co.za service (the “Service”), you acknowledge and agree to the following:
(a) The vehicle you list for sale is in your possession, and you have the right to transfer the advertised vehicle’s title to the purchaser.
(b) You are willing to sell the advertised vehicle at the price and on any other terms specified in your listing.
(c) You will purchase only one listing per unique vehicle and will not advertise more than one vehicle in a single listing, either by including descriptions of multiple vehicles or by updating the listing to advertise different vehicles.
(d) Upon selling or otherwise taking your vehicle off the market, you will delete the listing for that vehicle within 72 hours.
(e) You will not use your listing to advertise or promote anything other than one unique vehicle offered for sale, including any product, service, or business.
(f) You will owe Joburg Pretoria Cars (Pty) Ltd (“JPC”) for your listing, even if you fail to sell your vehicle or are dissatisfied with the Service.
(g) You will properly identify yourself as either an “Individual Seller” or a “Dealer.” A “Dealer” is any individual or entity in the business of selling vehicles or who has listed 4 or more vehicles for sale on the Joburgpretoriacars.co.za site within the previous 12 months from the listing start date. Anyone who does not meet the definition of a Dealer is an “Individual Seller.”
(h) If you place a listing with a material error that cannot be corrected through JPC’s provided tools, you will contact JPC customer service within 1 day of your original listing date to inquire about making material changes (e.g., listing the wrong model due to a typographical error), and JPC shall determine, in its sole discretion, whether such changes are permitted.
(i) You will not use the Joburgpretoriacars.co.za site, including your listing and any mobile or similar versions (the “Site”), for any fraudulent, false, misleading, or deceptive activity.
(j) All content and information you provide to JPC is truthful, accurate, and complete.
(k) You have the full right, title, and interest in and to all content, photos, and other material you provide to or post on Joburgpretoriacars.co.za.
(l) Photos provided for the listing will only show the vehicle listed for sale and may not include people, animals, or other objects not part of the vehicle.

JPC reserves the right, in its sole discretion, to remove any listing or photo, without notice and without liability or providing a refund, that does not meet these Sell Terms, JPC’s Terms of Service, JPC’s policies, or if JPC determines that your listing or content is inappropriate for any legal, business, technical, or other reason.

2. JPC Materials

By submitting ads, content, photos, data, or other materials (“Materials”) to the Site, you grant JPC a royalty-free, perpetual, irrevocable, nonexclusive, fully transferable, fully sublicensable right and license to copy, modify, display, distribute, perform, create derivative works from, and otherwise use and exploit all such Materials in any form, media, software, or technology now existing or developed in the future. You also grant JPC a royalty-free right and license to use your name, image, and likeness in connection with the reproduction or distribution of the Materials.

3. Sell Terms Acknowledgement

These Sell Terms apply only to the use of the Site for listing vehicles and do not cover JPC’s collection, use, or disclosure of information through other means (e.g., offline) or the practices of any third party. For third-party practices, please review their privacy policies. The Site contains links to other websites; JPC is not responsible for their content or practices. By using the Site, you acknowledge that you are at least eighteen (18) years old and agree to these Sell Terms, JPC’s Terms of Service, and JPC’s Privacy Policy.

4. Listing Details

Listings may be created only for vehicles and models specifically identified in JPC’s Build Your Ad Form or similar tools. You are solely responsible for the information, content, and photos in your listings. Listings contain only the features expressly indicated. Some features (e.g., “Certified Pre-Owned” logos) are available only to certain advertisers and may not be available to you. Listings may take up to 72 hours to appear on the Site. JPC MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE SERVICE, INCLUDING WHETHER YOU WILL SELL YOUR VEHICLE, OBTAIN AN ACCEPTABLE PRICE, RECEIVE LEGITIMATE INQUIRIES, OR RECEIVE ANY INQUIRIES.

JPC reserves the right, but is not obligated, to review listings before or after posting to confirm information, verify advertiser details, or investigate complaints or suspicious activity. If JPC determines, in its sole discretion, that you are engaging in unfair, deceptive, false, misleading, or fraudulent practices, JPC may reject or remove your listing without notice, liability, or refund.

5. Role of Joburg Pretoria Cars

JPC operates as an online platform facilitating communication between buyers and sellers of vehicles. JPC is not a party to any transaction between buyers and sellers and does not guarantee the accuracy of information provided by sellers or the condition, quality, safety, or legality of any vehicle listed. All transactions are conducted directly between buyers and sellers, and JPC has no control over or responsibility for the outcome of such transactions.

6. Liability and Indemnification

To the fullest extent permitted by law, JPC, its affiliates, officers, agents, and employees shall not be liable for any direct, indirect, incidental, special, exemplary, or consequential damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if JPC has been advised of the possibility of such damages), arising from:

  • The use or inability to use the Service.
  • The cost of procurement of substitute goods or services resulting from any goods, data, information, or services obtained through the Service.
  • Unauthorized access to or alteration of your transmissions or data.
  • Statements or conduct of any third party on the Service.
  • Any other matter relating to the Service.

You agree to indemnify and hold harmless JPC, its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Sell Terms, your violation of any law (including the CPA), or your use of the Service.

Nothing in these Sell Terms limits or excludes JPC’s liability for death or personal injury caused by its negligence, fraud, fraudulent misrepresentation, or any other matter where liability cannot be excluded or limited under applicable South African law.

7. Compliance with Laws

By listing a vehicle, you agree to comply with all applicable South African laws, including the Consumer Protection Act 68 of 2008 (CPA). The CPA requires you to disclose all material information about the vehicle, including any known defects, in your listing. Failure to comply may result in liability to the buyer under the CPA or other laws, and JPC shall not be responsible for any such liabilities.

8. Prohibited Activities

You agree not to use the Service for any unlawful purpose or in any manner inconsistent with these Sell Terms. Specifically, you agree not to:

  • Engage in fraudulent, false, misleading, or deceptive activity.
  • List any vehicle you do not own or have the right to sell.
  • Include content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Interfere with or disrupt the Service or connected networks.
  • Attempt unauthorized access to the Service or networks through hacking or other means.
  • Use any robot, spider, or other automatic device, or manual process, to monitor or copy content without JPC’s prior written permission.
  • Collect or harvest personally identifiable information from the Service.
  • Use the Service to advertise or offer to sell any goods or services other than vehicles as permitted by these Sell Terms.
  • Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which may harm JPC or users or expose them to liability.

JPC reserves the right to remove any listing or content that violates these prohibitions without notice or liability.

9. Termination

JPC may terminate or suspend your access to the Service and remove any listings, in its sole discretion, if it believes you have violated these Sell Terms, JPC’s Terms of Service, any applicable law, or engaged in fraudulent activity. Such termination or suspension may occur without notice and without liability or refund.

10. Governing Law

These Sell Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Sell Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Amendments

JPC reserves the right to modify these Sell Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the updated Sell Terms. JPC may also introduce new services or features, which will be subject to these Sell Terms.
